Special counsel Jack Smith moved to dismiss the four charges against President-elect Donald Trump related to the 2020 election plot. Citing longstanding DOJ policy, Smith argued that the Constitution requires dismissal before Trump’s inauguration. The Justice Department maintains that sitting presidents cannot be prosecuted.
